Terms of Service

1. Acceptance of Terms

By creating an account on the Interstate Equipment Company, LLC Customer Portal ("Portal"), you ("Customer") agree to be bound by these Terms of Service ("Terms"). If you are registering on behalf of a business entity, you represent that you have the authority to bind that entity to these Terms.

2. Portal Access & Account Security

The Portal provides Customer with access to rental account information, equipment tracking, document management, and communication tools. Customer is responsible for maintaining the confidentiality of their login credentials and for all activity that occurs under their account. Customer must notify Interstate Equipment Company, LLC immediately at service@iectexas.com if they suspect unauthorized access.

3. Account Verification

Interstate Equipment Company, LLC reserves the right to verify the identity and business information of any Customer requesting Portal access. Interstate Equipment Company, LLC may, at its sole discretion, approve, deny, or revoke Portal access at any time for any reason, including but not limited to: incomplete or inaccurate business information, failure to meet credit requirements, or violation of these Terms.

4. Equipment Rental Terms

Portal access does not constitute a rental agreement. All equipment rentals are governed by the separate Rental Agreement executed between Customer and Interstate Equipment Company, LLC at the time of rental. The Portal displays rental data, equipment status, and telematics information for informational purposes. While Interstate Equipment Company, LLC strives for accuracy, real-time data (including equipment hours, location, and status) is provided "as-is" and may be subject to delays or inaccuracies inherent in telematics systems.

5. Insurance Requirements

Customer is required to maintain adequate insurance coverage as specified in the applicable Rental Agreement. Certificates of Insurance ("COI") submitted through the Portal must name Interstate Equipment Company, LLC as an additional insured and loss payee. Failure to maintain required insurance coverage may result in suspension of rental services and/or Portal access.

6. Payment & Credit

By submitting a credit application through the Portal, Customer authorizes Interstate Equipment Company, LLC to verify the information provided and to conduct credit inquiries as necessary to evaluate creditworthiness. All payment terms, rates, and billing cycles are governed by the applicable Rental Agreement and/or credit terms established between Customer and Interstate Equipment Company, LLC.

7. Acceptable Use

Customer agrees not to:

  • Share Portal login credentials with unauthorized parties
  • Attempt to access data belonging to other customers
  • Use the Portal for any unlawful purpose or in violation of any applicable laws
  • Attempt to interfere with, compromise, or disrupt Portal systems or infrastructure
  • Upload malicious files, scripts, or content to the Portal
  • Use automated tools to scrape, crawl, or extract data from the Portal

8. Limitation of Liability

Interstate Equipment Company, LLC provides the Portal on an "as-is" and "as-available" basis. To the maximum extent permitted by law, Interstate Equipment Company, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from Portal use, including but not limited to: loss of data, business interruption, or equipment downtime resulting from inaccurate Portal information. Interstate Equipment Company, LLC's total liability shall not exceed the amount paid by Customer for Portal access (if any).

9. Modifications

Interstate Equipment Company, LLC reserves the right to modify these Terms at any time. Changes will be posted on the Portal with an updated effective date. Continued use of the Portal after changes are posted constitutes acceptance of the modified Terms.

10. Termination

Either party may terminate Portal access at any time. Interstate Equipment Company, LLC may suspend or terminate access immediately for violation of these Terms. Termination of Portal access does not affect any existing Rental Agreements or outstanding obligations between Customer and Interstate Equipment Company, LLC.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Rockwall County, Texas.
